Dear Mr. Ratcliff:

This letter is in response to your email dated Tuesday, September 17, 2002 sent at 17:52:51.  A copy of the email is enclosed with this letter.

Section II.(B) of the Memorandum of Understanding between UCSD and AS/GSA/Co-ops requires you to provide  “the AS, GSA, and respective Co-op with written notice specifying the violations and an opportunity for the Co-op to remedy the alleged violation(s)” when you believe that a Co-op has violated one of the items described in paragraph II.(A)1-7.  As far as we know, AS and GSA have not been notified, and we have not received written notice.

Furthermore, Section II.(C) states that “All disputes regarding items 2 and 5 above shall first be directed to the AS and GSA for informal resolution by the Oversight Committee … Resolution shall be in a timely manner, not to exceed 30 days, unless extended by all parties.”  You do not have the authority to unilaterally impose sanctions based on your opinion that we violated University Policies and Procedures. 

Section XXII. of the MOU further requires that a Co-op be “found by the relevant administrative agency, court or UCSD hearing committee or officer to have violated state or federal law or UCSD Policies and Procedures…” in order for the MOU to be terminated on those grounds.  Once again, you do not have the authority to unilaterally impose sanctions.  A court must find us guilty of violating federal law and the University Judicial Board must find us guilty of violating UCSD Policies and Procedures in order for you to take action based on your allegations.
